From redistricting to voter registration to setting up polling booths and counting, the entire process is controlled by the elected governments of the individual states. Gerrymandering is a term that describes how the ruling dispensation in each state rearranges Congressional district boundaries to maximise their advantages in the first past the post system. The chaos resulting from different rules and politically controlled processes were on full global display during the 2016 and 2020 presidential elections. In India, delimitation of parliamentary and state assembly constituencies is required to be carried out as per Articles 82 and 170 of the Constitution, under law to be enacted by Parliament. The Parliament has been enacting Delimitation Acts under which Delimitation Commissions, headed by retired Supreme Court judges, carried out the exercise. Same goes for preparation of electoral rolls and setting up of polling stations. Recognised political parties are notified about revision of electoral rolls. Electoral registration officers have to furnish the list of claims, objections, the draft and final lists to the registered parties. Political parties have to be notified about every change in location of a polling station. All these processes are conducted under ECI's supervision. There is no role for the central or state governments. District Collectors, who are designated as the District Election Officers (DEO), function directly under the ECI for these purposes. During the actual conduct of polling and counting, the ECI virtually takes control of the district administration, the DEOs, Returning Officers and their subordinates. It effects transfers of poll-related officers, including police officers. ECI appoints observers for each constituency who report directly to it. Each step is conducted under the supervision of representatives of political parties and candidates. This has always been the case -- both when ballot boxes were used and now with EVMs. EVMs and VVPATS to be used at different polling stations are randomised in the presence of representatives of political parties and for a second time, in the presence of candidates. They are then dispatched in the presence of candidates and their representatives are invited to put signatures on the seals of EVMs and VVPATs. Polling agents of candidates are present at each polling station. They are allowed to inspect the ballot boxes and sign the seals of EVMs and VVPATS before and after polling. Polling agents can put their signatures on Form 17C which gives an account of the number of votes cast. They can accompany the vehicles transporting EVMs to strong rooms. These rooms are sealed and opened in the presence of candidates. Counting of votes takes place in the presence of candidates and they can have their agents at each counting table. They can verify the tally for each EVM and match them with Form 17C. Each step is video graphed. It's difficult to find such an elaborate and foolproof system anywhere in the world. We will do well to market our election management system to developing and even some developed countries whose election processes leave much to be desired.
